PART I: GENESIS & LEGAL FOUNDATION

The Starting Point

Trump signed an executive order on September 22, 2025, designating “Antifa” as a domestic terrorist organization, directing federal agencies to investigate, disrupt, and dismantle operations by Antifa or those supporting it, including criminal prosecution [1]. The order also directed the IRS to withdraw tax-exempt status from any organization identified as funding political violence [6].

However, “Antifa” is not an organization — it is a movement and ideology with no centralized structure, defined leadership, or membership rolls. This creates the foundational question: Does Antifa need to be formally organized? And what would happen if people formed a 501(c)(3) nonprofit dedicated to nonviolent civic engagement and constitutional education?

Constitutional Protections for Nonprofit Formation

IRS & Tax-Exempt Status Protections

Neither the President, Justice Department, Treasury Department, nor IRS can revoke tax-exempt status through executive order or presidential directive. Federal law (26 USC Section 7217) makes it a federal crime for senior executive branch officials, including the President, to request the IRS conduct or cease an audit of any specific taxpayer, with penalties including fines up to $5,000 and imprisonment up to five years [1a][2a].

The IRS must follow established administrative procedures for revocation, requiring individual case-by-case audits with ample opportunity for the organization to defend itself and multiple routes of appeal [1a][2a].

First Amendment Protections

The Supreme Court in NAACP v. Alabama (1958) established that “freedom to engage in association for the advancement of beliefs and ideas is an inseparable aspect of the ’liberty’ assured by the Due Process Clause of the Fourteenth Amendment,” regardless of whether the beliefs are political, economic, religious, or cultural [5a].

It would violate the First Amendment to prosecute all those who subscribe to anti-fascist ideology, particularly given that such a movement lacks centralized structure or defined leadership [6a].

501(c)(3) Political Activity Limitations

For over 70 years, the Johnson Amendment has prohibited 501(c)(3) organizations from participating in or intervening in any political campaign on behalf of or in opposition to any candidate for public office [7a].

A proposed organization could:

  • Engage in issue advocacy (opposing fascism, supporting constitutional principles)
  • Conduct voter education (non-partisan)
  • Take positions on public policy issues

But could NOT:

  • Endorse or oppose political candidates

Even if a statement doesn’t expressly tell an audience to vote for or against a specific candidate, the organization is at risk of violating the prohibition if there is any message favoring or opposing a candidate [8a].

The Executive Order Problem

Trump’s EO designating “ANTIFA” as a domestic terrorist organization is itself likely unconstitutional because:

1. No Statutory Authority

  • 18 U.S.C. § 2331 defines “domestic terrorism” but creates NO designation mechanism
  • Only foreign terrorist organizations can be designated (8 U.S.C. § 1189)
  • Congress never authorized domestic designations
  • No constitutional provision or statute grants any president the power to designate a domestic civil society organization as a “domestic terrorist organization” [2b][3b]

2. Void for Vagueness

  • “ANTIFA” is not an organization (no members, no structure, no leaders)
  • Covers ideology/movement (First Amendment protects belief)
  • Impossible to know what conduct is prohibited

3. Viewpoint Discrimination

  • Targets anti-fascist viewpoint
  • Doesn’t target fascist organizations
  • First Amendment prohibits viewpoint-based restrictions

4. Due Process Violations

Legal scholars’ view: The Cato Institute (libertarian), ACLU (liberal), and other legal experts agree this type of EO exceeds presidential authority [12b].

Despite strong legal protections, organizations would face:

Enhanced Scrutiny: Trump’s September 2025 executive order directed the Treasury Department to identify and disrupt financial networks that fund “domestic terrorism and political violence,” and the IRS to withdraw tax-exempt status from organizations identified as funding political violence [9a].

Aggressive Reinterpretation: The administration may push the IRS to aggressively reinterpret the “illegality doctrine” to revoke exempt status of organizations performing activities typically permitted by law, including those that “aid or abet violations of federal immigration law,” “support terrorism,” or engage in patterns violating state tort laws including trespassing, public nuisance, and disorderly conduct [10a].

Targeting of Funders: Trump has called for investigating funders of left-wing organizations, specifically naming George Soros and Reid Hoffman, with the FBI Joint Terrorism Task Force in the lead [9a].

No Formal Designation Process Needed: While there’s no legal mechanism to designate domestic terrorist organizations, the administration can assert the authority to do so and has thousands of armed federal law enforcement agents ready to carry out orders [11a].

Feasibility Assessment

Legally: 7/10 The federated structure is sound and has precedents. The homonymic defense is creative and forces interesting legal questions. Will win many battles.

Practically: 3/10 The resources required are staggering and facing an adversary that has shown willingness to ignore legal constraints. The administration asserts authority to designate domestic terrorist organizations despite no legal mechanism existing [11a].

Strategically: 8/10 Even if it “fails,” creates:

Trump discussed bringing RICO charges against left-wing groups, saying they should be put in jail for what they’re doing to the country [6c].

Government argument: “These 3,200 entities are a single racketeering enterprise using legal fiction to evade designation. They coordinate via ‘protocol’ - this is conspiracy.”

Defense: Protocol-based coordination is identical to how internet standards (TCP/IP, HTTP) work. No one claims the IETF is a “conspiracy” because it publishes RFC documents that millions of entities voluntarily implement.
